Surearly Terms of Service
These Terms of Service (“Terms”) define the rights, obligations, and responsibilities between Sugentech, Inc. (“the Company”) and users (“Members”) regarding the use of the Surearly service (“the Service”).
1. Purpose
The purpose of these Terms is to set forth the conditions and procedures for using the Surearly Service provided by the Company, and to define the respective rights, obligations, and responsibilities of the Company and its Members.
2. Definitions
The terms used in these Terms are defined as follows:
2.1. “Service” refers to the mobile application and all related services provided by the Company.
2.2. “Member” refers to an individual who agrees to these Terms and uses the Service.
2.3. “Account” refers to the email address and authentication method designated by a Member for identification and access to the Service.
2.4. “Content” refers to information, data, documents, images, and other materials provided within the Service or entered and stored by the Member.
2.5. “Sensitive Information” refers to personal data defined as sensitive under the Personal Information Protection Act (Korea) including information such as health data, menstrual records, hormone test results, and postpartum depression test results.
3. Effect and Amendment of the Terms
3.1. These Terms take effect when a Member registers for or uses the Service.
3.2. The Company may revise these Terms in accordance with changes to applicable laws or service policies. Any revisions will be announced at least 7 days prior to their effective date (or 30 days prior for material changes) via in-app notice or equivalent means.
3.3. If a Member does not agree to the revised Terms, they may request account deletion. Continued use of the Service after the effective date will be deemed as acceptance of the revised Terms.
4. Membership Registration and Account Management
4.1. Members may create an account by providing required information such as email address, nickname, and date of birth.
4.2. Members are responsible for safeguarding their account credentials and passwords (including simple passwords) and must not transfer or lend them to third parties.
4.3. The Company may reject registration or suspend/terminate an account under the following circumstances:

Providing false or stolen information
•
Violating laws or these Terms
•
Interfering with the normal operation of the Service
5. Provision and Modification of the Service
5.1. The Company provides the following services:
•
Menstrual cycle and ovulation prediction, and health record tracking
•
Recording of basal body temperature, weight, symptoms, exercise, medication, and hospital visits
•
Expected delivery date calculation and weekly pregnancy guidance
•
Postpartum depression assessment and related information
•
Hormone test result recording, analysis, and pattern tracking
•
Personalized content, notifications, and other health management support features
5.2. The Company may modify the contents of the Service for improvement or technical reasons.
5.3. The Company may partially or fully suspend the Service if operationally necessary, and in unavoidable cases, may notify users afterward.
6. Member Obligations
6.1. Members shall comply with applicable laws and these Terms.
6.2. Members shall not engage in the following acts:

Providing false information or using another person’s account
•
Infringing on the intellectual property, reputation, or privacy of the Company or others
•
Interfering with the stable operation of the Service (e.g., hacking, using illegal software)
•
Using the Service for unlawful purposes (e.g., advertising, distribution of obscene material)
7. Company Obligations
7.1. The Company shall make reasonable efforts to provide the Service stably in accordance with applicable laws and these Terms.
7.2. The Company shall safely manage Members’ personal and sensitive information in compliance with applicable laws, the Privacy Policy, and the Sensitive Information Processing Policy.
7.3. The Company shall implement technical and administrative security measures to ensure safe Service use.
8. Paid Services and Payment
8.1. Some features of the Service (e.g., advanced analysis or premium content) may be offered as paid services. Payment and refund policies will follow separate operational guidelines.
8.2. If a Member is a minor, parental or legal guardian consent is required. Payments made without consent may be canceled.
9. Intellectual Property Rights
9.1. All intellectual property rights related to the Service, including its software, design, text, graphics, and images, belong to the Company.
9.2. Members may use Service content solely for personal purposes and may not reproduce, distribute, or use it for commercial purposes without prior written consent from the Company.
10. Limitation of Liability and Disclaimer
10.1. The Company shall not be liable for Service disruptions caused by force majeure events such as natural disasters, communication failures, or server issues.
10.2. Health-related information and content provided through the Service are for informational and educational purposes only and do not replace professional medical diagnosis or treatment.
10.3. The Company is not liable for damages resulting from the Member’s fault, including poor account management or submission of false information.
11. Dispute Resolution and Governing Law
11.1. Any disputes arising between the Company and Members shall, in principle, be resolved through mutual consultation.
11.2. If a dispute cannot be resolved amicably, it shall be governed by the laws of the Republic of Korea, and the competent court shall be the court having jurisdiction over the Company’s headquarters.
12. Miscellaneous
12.1. Even if any provision of these Terms is deemed invalid, the remaining provisions shall remain in full effect.
12.2. These Terms may be provided in multiple languages, but the Korean version shall prevail in case of any discrepancy.
